Purpose: To provide information and guidance to staff on maintaining privacy and confidentiality.

Scope: This policy applies to all personal privacy, property, communications and information, which is not in the public domain. It contains information and guidance from legislation and from relevant bodies that we expect all staff to adhere to, including:

  • Health and Social Care Act 2008 (Regulated Activities) Regulations 2014.
  • Data Protection Act (1998) and General Data Protection Regulations 2018.
  • Human Rights Act (1998).
  • Oher relevant guidance.

Managers should check guidance from relevant bodies regularly to ensure they are up to date with the latest information about privacy and confidentiality and will amend this policy accordingly.

Tuskers Care Solutions expects staff to adhere to this legislation through implementation of the policy.

Policy

  • Tuskers Care Solutions respects the privacy of all service users and recognises that individuals are unique in the way they live their lives. Staff are bound by Tuskers Care Solution’s privacy and confidentiality policy. Any staff member who has access to confidential information enters has an obligation to keep such information private and confidential during and after employment with Tuskers Care Solutions. This also means not using private or confidential information for illegitimate purposes.
  • Staff will not divulge to third parties any private or confidential matters (whether or not covered by this policy) without written explicit authorisation from the service user and with logical explanations of why the information needs to be shared.
  • Where the service user agrees to the sharing of confidential information, staff will only share this with others on a need-to-know basis.
  • Where Tuskers Care Solutions discovers an actual or potential breach of this policy, it will act quickly with service users to seek redress to prevent further damage to the service user or Tuskers Care Solution’s reputation.
  • Staff who divulge private or confidential information to third parties about service users will be held personally liable for any legal action taken against them by the service user.
  • Except where otherwise agreed, all private knowledge of the service user including their personal preferences, possessions, finances, data, or other information collected during the staff member’s employment will remain private.
  • Tuskers Care Solutions will treat breaches of privacy and confidentiality as gross misconduct.
